Terms of Use

1. Introduction

These Terms of Use ("Terms") govern your access to and use of the Oceansix My Aqua mobile application ("My Aqua" or the "App"), operated by Oceansix Labs (Pty) Ltd ("Oceansix", "we", "us", or "our"), a company registered in the Republic of South Africa.

My Aqua is an Android application that allows registered users to record, track, and manage aquatic environment data using metric units and International English.

By downloading, installing, or using My Aqua you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Acceptance of Terms

You are required to accept these Terms during the registration process before you may access or use My Aqua. Continued use of the App after any update to these Terms constitutes your acceptance of the revised Terms. We will notify registered users of material changes via the email address associated with their account.

3. Eligibility

My Aqua is intended for users who are eighteen (18) years of age or older. By registering for an account you represent and warrant that you are at least 18 years old. If we become aware that a user is under 18, we reserve the right to suspend or terminate that account immediately and without notice.

4. Account Registration and Responsibility

To use My Aqua you must create an account by providing the following information:

• A display name
• A valid email address
• Your country of residence
• A password of your choosing

You must confirm your email address before you may access the App. A confirmation email will be sent to the address you provide during registration; your account will remain inactive until confirmation is complete.

During registration you will be asked whether you consent to receiving marketing communications from Oceansix. This consent is entirely optional and is separate from your acceptance of these Terms.

You are responsible for maintaining the accuracy of your account information. You may change your email address at any time; however, a new confirmation step will be required before the change takes effect.

5. Security of Credentials

You are solely responsible for keeping your password confidential and for all activity that occurs under your account. You must notify us immediately at hello@oceansix.co.za if you suspect any unauthorised access to or use of your account.

A password-reset facility is available from the App's sign-in screen. Password resets are processed via the email address registered to your account.

6. Permitted Use

You may use My Aqua only for its intended purpose: recording, managing, and reviewing your own aquatic environment data. You agree not to:

• Use the App for any unlawful, fraudulent, or harmful purpose;
• Attempt to gain unauthorised access to any part of the App, its servers, or any systems connected to the App;
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App;
• Reproduce, distribute, publicly display, or create derivative works based on the App or any of its content;
• Use automated scripts, bots, or other means to interact with the App;
• Interfere with or disrupt the integrity or performance of the App or the data it contains;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Upload or transmit viruses, malware, or any other harmful code through the App.

7. Availability and Service Changes

We strive to keep My Aqua available at all times; however, we do not guarantee uninterrupted or error-free access. The App may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our reasonable control.

We reserve the right to modify, suspend, or discontinue any feature or functionality of the App at any time, with or without notice. We will endeavour to provide reasonable notice of material changes where practicable.

8. Intellectual Property

All intellectual property rights in the App — including but not limited to the software, design, text, graphics, logos, icons, and trademarks — are owned by or licensed to Oceansix Labs (Pty) Ltd. Nothing in these Terms grants you any right, title, or interest in that intellectual property except the limited right to use the App in accordance with these Terms.

"Oceansix" and "My Aqua" are trademarks of Oceansix Labs (Pty) Ltd. You may not use these marks without our prior written consent.

9. User Content and Data

You retain ownership of any data you enter into My Aqua ("User Content"). By submitting User Content you grant Oceansix Labs a non-exclusive, royalty-free licence to store, process, and display that content solely for the purpose of providing and improving the App.

You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We do not monitor User Content as a matter of course but reserve the right to remove any content that, in our reasonable opinion, violates these Terms or applicable law.

10. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using My Aqua you consent to the practices described in the Privacy Policy.

Transactional emails (such as email confirmations and password resets) are sent from noreply@oceansix.co.za. Please ensure this address is not blocked by your email filters.

11. Account Suspension or Termination

We may suspend or terminate your account at any time, with or without cause or notice, if we reasonably believe that you have breached these Terms, engaged in fraudulent or unlawful activity, or otherwise acted in a manner that may harm Oceansix, other users, or third parties.

You may delete your account at any time through the App. Upon deletion, your account and associated data will be removed in accordance with our Privacy Policy and applicable data-protection legislation.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Oceansix Labs (Pty) Ltd, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, or business opportunity, arising out of or in connection with your use of or inability to use My Aqua.

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under South African law, including liability for fraud or gross negligence.

13. Indemnity

You agree to indemnify, defend, and hold harmless Oceansix Labs (Pty) Ltd, its directors, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your use of the App, or your violation of any applicable law or the rights of any third party.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will notify registered users via email and update the effective date at the top of this page. Your continued use of My Aqua after such changes constitutes acceptance of the revised Terms.
